Amarnex Website and Platform Terms of Use
These Terms of Use govern access to Amarnex websites, demonstrations, portals, applications, APIs, support channels, and SaaS platform. By accessing or using a service, you confirm that you have read these terms and have authority to accept them for yourself or the organization you represent. A signed subscription order, statement of work, data processing agreement, or other written contract may add or replace provisions for a specific customer.
About Amarnex
Amarnex provides digital products and services for real estate businesses, including tools that may support customer relationships, sales, leasing, property operations, communications, reporting, automation, integrations, and selected AI-assisted workflows. Feature availability depends on the purchased plan, country, configuration, third-party services, technical validation, and written contract.
Eligibility and authority
You must have legal capacity to enter an agreement and, when acting for an organization, authority to bind it. Business administrators are responsible for approving users, assigning appropriate roles, and ensuring use complies with internal policy and applicable law.
Account registration and security
You must provide accurate account information, keep credentials confidential, use reasonable security measures, and notify Amarnex promptly of suspected compromise. You are responsible for activity under your account unless caused by Amarnex’s breach of an express obligation. Shared credentials, attempts to bypass authentication, or access outside assigned permissions are prohibited.
Permitted use
You may use the service for your organization’s legitimate real estate and related business operations within the documented functionality, purchased scope, and applicable law. You may allow authorized employees, contractors, or agents to use it under your control. You remain responsible for their conduct and for configuring workflows, permissions, notices, approvals, and retention settings.
Prohibited use
You may not use the service to break the law; violate privacy, intellectual-property, consumer, communications, advertising, competition, or real-estate rules; upload malicious code; interfere with security or availability; probe or reverse engineer except where law expressly permits; scrape or copy the service at scale; impersonate another person; send unlawful or unsolicited communications; make discriminatory or deceptive decisions; or use outputs to cause harm. You may not resell, sublicense, or provide the service as a bureau without written authorization.
Customer content and responsibilities
You retain ownership of content and business data you submit. You grant Amarnex a limited right to host, process, transmit, display, back up, and otherwise use that content only to provide, secure, support, and improve the contracted service as permitted by the agreement and privacy policy. You confirm that you have the rights and legal basis required to collect and process the content, including notices and consents for personal data, marketing, call recording, messaging, and connected systems.
AI-assisted features
Selected features may generate, classify, summarize, recommend, or automate steps using models and information available to the service. Outputs can be incomplete, inaccurate, outdated, or unsuitable for a particular decision. Users must review material outputs before acting, especially for pricing, eligibility, contracts, financial commitments, legal rights, compliance, or communications. AI functions do not replace professional legal, financial, valuation, engineering, or regulatory advice. Availability and model providers are confirmed in product documentation or the customer agreement.
Calls messages email and recordings
If communication functions are enabled, the customer is responsible for lawful sender identification, recipient preferences, consent, do-not-contact rules, permitted hours, message content, call recording notices, and retention. Local requirements differ across KSA, UAE, Egypt, and other markets. Amarnex may provide workflow controls, but the customer remains responsible for its campaign and communication decisions.
Third-party services and connectors
The service may link to or exchange data with third-party products. The customer authorizes the data flows it configures and must maintain the necessary third-party accounts, licenses, permissions, and lawful basis. Third-party terms, availability, security, and changes are controlled by their providers. A name or logo on the website does not by itself confirm a formal partnership, certification, live connector, or support in every country.
Intellectual property
Amarnex and its licensors retain all rights in the platform, software, interfaces, documentation, designs, trademarks, models, workflows, and improvements, excluding customer content. No rights are granted except the limited right to use the service during the authorized term. Feedback may be used to improve Amarnex without restriction or payment, provided it does not disclose customer confidential information.
Confidentiality
Each party must protect the other party’s non-public business, technical, security, and commercial information using reasonable care and use it only for the relationship. Confidentiality does not cover information lawfully public, already known without restriction, independently developed, or properly received from another source. Required disclosures must be limited and, where legally permitted, preceded by notice.
Privacy and data protection
Personal-data processing is governed by the Amarnex Privacy Policy, the customer contract, and any data processing agreement. Customer data remains customer-controlled and is not sold. Access is limited to authorized purposes such as service delivery, support, security, and legal compliance. The parties must fulfill their respective responsibilities under Saudi PDPL and other applicable laws.
Availability changes and support
Amarnex may maintain, update, secure, or modify the service. Material contracted commitments, service levels, support hours, maintenance notice, and remedies are defined in the applicable order or agreement. Preview, beta, evaluation, and free features may change or end and may be provided without a service-level commitment. Amarnex will avoid materially reducing paid core functionality during a committed term except for security, legal, third-party, or technical necessity, subject to the contract.
Fees and taxes
Fees, billing cycles, currencies, payment dates, user or usage limits, taxes, renewal, and refund rules are stated in the signed order or subscription agreement. Unless that document states otherwise, charges are exclusive of applicable taxes and the customer is responsible for taxes other than taxes on Amarnex’s income.
Suspension and termination
Amarnex may suspend access when reasonably necessary to address a security threat, unlawful use, material breach, non-payment, harm to the service or others, or a binding legal request. Where practical, Amarnex will provide notice and an opportunity to remedy. Termination rights, data export, transition, deletion, and surviving obligations follow the customer contract and Privacy Policy.
Disclaimers
Marketing content describes intended value and does not guarantee revenue, collection improvement, conversion, occupancy, accuracy, response rates, regulatory approval, or a particular business result. Except for express written warranties, the service is provided to the extent permitted by law without implied warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Mandatory statutory rights remain unaffected.
Liability
Liability exclusions, caps, carve-outs, indemnities, and claim procedures must be stated in the signed customer agreement and comply with applicable law. Until approved there, neither party should rely on website copy as the complete allocation of commercial risk. Nothing excludes liability that cannot lawfully be excluded, including fraud or other mandatory responsibility.
Indemnity
To the extent set out in the customer agreement, the customer may be responsible for third-party claims arising from unlawful customer content, instructions, communications, misuse, or violation of rights. Amarnex may be responsible for specified intellectual-property claims relating to the unmodified contracted service. Scope, defenses, control, notice, exclusions, and remedies require express written agreement.
Governing law and disputes
The governing law, courts or arbitration forum, language priority, notice addresses, and escalation process must be specified in the contracting entity’s approved customer agreement. For a Saudi contracting entity, Saudi Arabian law and competent Saudi authorities may be selected subject to legal review. These website terms must not be published with a final forum until the legal entity and dispute clause are approved.
Changes to these terms
Amarnex may update these terms for service, security, legal, or operational changes. The revised version will state its effective date. Material changes affecting an active paid subscription will be handled according to the customer agreement and applicable notice requirements. Continued use after an effective update constitutes acceptance only where permitted by law.
